Liveview Technologies, Inc. manufacturers a surveillance system that consists of a base on wheels with blue LED lights, static and strobing, and a tower with cameras, blue LED lights, and loudspeakers. LVT has admitted under oath that the system is used for “active deterrence” and that the technology such as the blue LED lights are meant to “deter anyone in the area.” LVT has also admitted under oath that “LVT has the capability to remotely control” the system.
Discrimination
Title III of the Americans with Disabilities Act prohibits discrimination “by any person who owns, leases (or leases to), or operates a place of public accommodation.” 42 U.S.C. § 12182(a). Lentini v. California Center for the Arts 370 F.3d 837 (2004) confirms that an “operator” under the ADA “retains accountability for those in a position to ensure nondiscrimination.” The operation of an LVT system is a shared responsibility by LVT, the client business, and the shopping center owner. All three entities are responsible for ADA compliance.
The California Unruh Civil Rights Act (Cal. Civ. Code § 51) states that all individuals “are entitled to the full and equal accommodations, advantages, facilities, privileges, or services in all business establishments of every kind whatsoever.” In the case In re Cox (1970) 3 Cal. 3d 205, the Court wrote, “We therefore conclude that a business generally open to the public may not arbitrarily exclude a would-be customer from its premises…” The Court gives the example, “The shopping center may [not] exclude individuals who wear long hair or unconventional dress, who are black, who are members of the John Birch Society, or who belong to the American Civil Liberties Union, merely because of these characteristics or associations…”
Because LVT has admitted under oath that the LVT system is designed to “deter anyone in the area”, the use of the technology on the LVT system, including the blue LED lights and the alerts from the loudspeakers, is a violation of the Americans with Disabilities Act and the California Unruh Civil Rights Act.

April 2, 2025 – LVT releases industry-first mobile security unit talk down powered by Agentic AI and other features – Article Quote: “Agentic AI-powered audio talk down uses situational context to issue a personalized audio message to potential bad actors, identifying the individual who triggered the alert by what they are wearing or holding. ” – In California, it is unlawful to discriminate against individuals based on what they are wearing.
